How Much More Will The 2022 Crop Cost?

Agribusiness Blog

The 2021 corn and soybean crop has likely been the most profitable crop for these farmers since at least 2013. With 2022 prices remaining strong, many might assume that the 2022 crop will be just as good. However, just like everything else, there appears to be strong inflation in crop inputs for 2022. My friend Chris Barron of Agview Solutions does a lot of consulting with corn and soybean farmers (along with other crops) across the corn belt.

Grazing for Water Management January 21st, 2022

RR2CS

Agricultural producers who move fence and livestock daily or every few days during the growing season have talked about the benefits of adaptive multi-paddock (AMP) grazing, sometimes called rotational grazing, for soil health, plant diversity and their livestock for quite some time now. But did you know that AMP grazing can also improve water infiltration in your soil?

MAINE'S FOOD BILL OF RIGHTS LEGALESE

The Lunatic Farmer

My last post garnered the comment that this new constitutional amendment in Maine does not guarantee food commerce; the language speaks more to personal production and consumption. The way I understand the legal framing of it, though, it IS about commerce because it uses the terms that give people legal standing. You cannot sue for redress of a right you don't have.

Can I Have Some SALT With That?

Agribusiness Blog

Most of us know that Congress limited the state and local tax deduction (SALT) to $10,000 starting in 2018. Certain House and Senate members from high tax states such as New Jersey, New York and California have complained about this. Also, many of these states have enacted certain workarounds for pass-through entities that would allow a state income tax deduction at the entity level.

As Usual – I am Wrong

Agribusiness Blog

I have been teaching tax update classes the last couple of weeks and one of the questions still left unanswered is whether taxpayers who reimburse employees for meals using a per diem qualify for the 100% restaurant meals deduction or whether it is still a 50% meal deduction. During these sessions I surmised that it was likely a 50% meals deduction unless the employee provided some type of evidence that they obtained a meal from a restaurant.

Second Amendment for Food

The Lunatic Farmer

A ballot initiative you may not have heard about in Maine late Tuesday created unprecedented freedom for voluntary food commerce. This first-of-its kind constitutional amendment does what the U.S. Bill of Rights failed to do: guarantee citizens the right to choose their food. The measure added language to the state constitution providing that individuals have a “ natural, inherent, and unalienable right to food, including the right to save and exchange seeds and the right to grow, raise, harvest

The Three C’s of Succession Planning

Agribusiness Blog

I taped a podcast yesterday with Dave Specht who is the director of Global Family Business Institute at The Drucker School of Management and perhaps more importantly lives in Basin City, Washington (I will let you look it up on a map). During that podcast (which will be available in the next week or so), we discussed what makes a good family farm transition and he mentioned the three C’s that are needed as follows: Contingency planning – Has the family determined what would happen if

Valuation Discounts: What’s the big deal?

Agribusiness Blog

Now that the proposal to eliminate valuation discounts for gift and estate tax valuations were removed from the Build Back Better Act, at least for now, you may be wondering what all the fuss was about. Transferring valuable assets to the next generation while minimizing tax ramifications is one of the goals of most estate planning. For farmers the most valuable asset included in the estate planning process is typically farmland.

Just a note to let you know that when I uploaded yesterday’s blog post that the table showing the valuation example did not come over and I did not notice it until a reader sent me an email. I have updated the post and you can check it here.

Update on Congress Tax Proposals

Agribusiness Blog

A new Build Back Better Act was released today. Several changes were provided in this new bill that may be of interest to farmers and other taxpayers. Likely there will be additional changes and based on the elections last night nationwide this may not even get enacted. After last week’s release, hardly any bad provisions remain in these bills regarding income or estate taxes.

What Property Qualifies for 1031 Exchange

Agribusiness Blog

Many farmers are considering selling their land this year due to rapid appreciation in the value or to escape any possible capital gains tax increases. However, many of them also plan on deferring the gain into other real estate using a tax-deferred exchange under Section 1031. This is very easy if the only property sold is raw land with no buildings or land improvements such as tiling.

Is Third Quarter The End of ERC

Agribusiness Blog

The House has finally passed the transportation infrastructure bill and President Biden is likely to sign it soon. This bill provides money for “physical” infrastructure needs along with other pet projects of Congress members. However, there is also one key tax consideration buried in the bill that will be of concern to many farmers. Those farmers who qualify for the Employee Retention Credit (ERC) for the fourth quarter will no longer be allowed to claim the credit due to this bil
